The appellee, plaintiff, in the court below, sued the Wichita Falls & Wellington Railway Company of Texas and the Wichita Valley Railway Company for alleged damages to an “emigrant” shipment from Spur, Tex., to Wellington, Tex., claiming that he consummated an oral contract with the agent of the Wichita Valley Railway Company at Spur, Tex., for the shipment of said “emigrant” ear at the agreed freight rate of $50 for the through transportation, and that when said shipment reached Wellington, the destination, the Wichita Palls & Wellington Railway Company of Texas refused to surrender the same…
