delivered the opinion of the court:

The appellee, Annie E. Yniestra, brought her suit in the above stated county to recover damages from the L. & H. R. R. Co. for the killing of her husband, Moses G-. Yniestra, by an engine and tender operated by the employes of the defendant company. On the trial of the cause it appeared that Moses Gr. Yniestra on the morning of the 14th *722day of February, A. D. 1884, was walking on the track of the Pensacola and Atlantic R. R. Co. There was another track running parallel, at the distance of eight feet, with the one on which Yniestra was found,…
