Plaintiff brought this lawsuit for employee benefits under the Employee Retirement Income Security Act (ERISA). Shortly before the trial began, Prudential Insurance Company settled its dispute with plaintiff. Safeco Life Insurance Company was unable to come to terms with plaintiff, and it remained the sole defendant in this action. The issue in this lawsuit is whether plaintiff had practical and beneficial sight in his right eye before it was surgically removed. This court concludes that he did and rules in his favor.
