Herchel and Vicki Bacon appeal the decision of the trial court to terminate their parental rights asserting that in those termination cases where (1) a reunification order has been in place for less than a year and (2) the child is not in the custody of the parent whose rights are subject to termination, termination proceedings may not take place.
