MEMORANDUM
MERHIGE, District Judge.
This is an action brought by Robert C. Willis pursuant to § 205(g) of the Social Security Act, 42 U.S.C. § 405(g), in which he seeks review of the final decision of the Secretary of Health, Education and Welfare, denying his claim for disability insurance benefits. The matter is before the Court upon the Secretary’s motion to dismiss, alleging that the Court lacks subject matter jurisdiction because the action was not commenced within the sixty day period prescribed by statute.
