This action had its origin in the Probate Court of Jackson County. The plaintiff filed a petition in that court asking an allowance against the estate of his brother, Joseph F. Meffert, ■on three promissory notes, claimed to have been made by the latter to the plaintiff, as follows: one for $2,900.50, one for $500, and one for $375.27; each of these notes bore interest at the rate of six per cent per annum, payable annually, and if not so paid the interest was to be compounded and become a part of the principal.
