Plaintiff John Doe — proceeding pseudonymously as “Kidane” — ciaims he was tricked into downloading a computer program. The program allegedly enabled the Federal Democratic Republic of Ethiopia (Ethiopia) to spy on him from abroad. He wants to sue the Republic of Ethiopia. But foreign states are immune from suit unless an exception to the Foreign Sovereign Immunities Act (FSIA) applies. Ki-dane invokes the FSIA’s exception for noncommercial torts.
