KRUEGER, Judge.

— Appellants were convicted of the offense of an assault with intent to commit rape, and their punishment was assessed at confinement in the state penitentiary for a term of twenty years.

The indictment in this case contains two counts. The first count charges that Macedonia Munoz and Anselmo Arredondo on or about the 17th day of September, 1936, in Val Verde County did unlawfully in and upon Mary Ann Scales, a woman, make an assault, with the intent then and there without her consent by force, threats, and fraud to have carnal knowledge of her.
