McNamee, J.:
This is an action brought by the State to quiet title to certain land described in the complaint. The State’s claim of title stems from deeds, made in 1872 to the Virginia and Truckee Railroad Company wherein the *140grantors were Thomas Hayden and wife, A. J. Hatch and wife, M. C. Lake, and George Deremer.
The said 1872 deeds all contained in the granting clauses the following language:
“* * * has granted, bargained, sold, . aliened, remised, released, conveyed and confirmed, and by these presents does grant, bargain, sell, alien, remise, release, convey and confirm…
