I concur with the majority opinion that the trial court misapplied the law when it relied on Officer Teitsort’s testimony to support a conclusion that there was no probable cause; however, I would remand to the trial court for a determination whether there was probable cause based on any credibility determinations of the court. There are two competing precepts of law in the analysis of this case.
