The plaintiff, United Food and Commercial Workers Local Union Number 7R (the Union), appeals from an order of the district court denying the Union’s motion to vacate an arbitration award in favor of defendant Sandra Cortez, an employee of defendant Safeway Stores, Inc. (Safeway), and entering judgment against the Union for back pay and interest. The Union contends on appeal that (1) Cortez has no standing to seek to enforce the award; (2) the arbitrator exceeded his authority by assessing part of the back pay award against the Union because of its delay in bringing…
