Defendant below, Green Pastures Water Company, Inc., appeals from an order denying its plea of privilege to be sued in the county of its domicile.
Plaintiff below, Ronald B. Zent, was a developer of a subdivision in Hays County, named “Brushy Creek Estates.” On May 23, 1975, defendant, who supplied water to several subdivisions in the area, agreed to sell water to “purchasers of lots in Brushy Creek Estates, an unrecorded subdivision situated in Hays County, Texas, owned by Zent.” In March 1976, a second agreement was entered, which purported to amend the May 1975…
