Appeal "by the defendant, J. H. Barker & Oo., from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of Kings on the 4th day of May, 1897, upon the verdict of a jury for $3,000, and also from an order entered in said clerk’s office on the 3d day of May, 1897, denying the defendant’s motion for a new trial made upon the minutes.

Goodrich, P. J.:. The plaintiff, a girl of fifteen of sixteen-years of age, was injured on January 12," 1895, while in the employ of the defendant, which had a factory in the city of New York for the grinding and manufacture of chocolate. She had been in the employ of the defendant five dayls, when she was- set at work upon a grinding machine, called a “ Melanger.” The machine was used for the purpose of grinding chocolate by means of a heavy stone roller which revolved inside of a circular pan-shaped receptacle.
