This is an appeal from the Supreme Court of the Territory of Utah.
The action was commenced in the District Court of the Third Judicial District of Utah Territory, county of Salt Lake, by a complaint in the name of the people of the Territory of Utah, by William II. Dickson, United States Attorney of said Territory, against the present appellant, then defendant, Nephi W.
