On the 6tk of February, 1865, the complainant and his wife conveyed to Jesse Holcomb, father of the defendant William, the east half of the south-east quarter of section 6, in township 7 north, of range 6 west, in this state, for the consideration of two thousand dollars, and to secure this purchase money Jesse Holcomb gave to complainant his promissory note, payable to him or bearer in two years, with annual interest, and likewise executed and delivered to him a mortgage on the land to accompany the note.

On receiving the note and mortgage, the complainant left them in the hands…
