RIBNER, J.,

Plaintiffs have applied for a preliminary injunction enjoining the use of the proceeds of a United States Treasury check in the amount of $57,962.75 payable to defendants, Aaron and Melba Eisenstein, and deposited with defendant, The First Pennsylvania Banking and Trust Company.

A temporary injunction was issued without hearing by Hirsh, J., on May 31, 1972, and a preliminary injunction was ordered by this court on June 5, 1972, after hearing.

At the hearing, the following was established: Plaintiffs are Warren Eisenberg, Robert Grossman, Marvin Rosenbaum and Herbert Weinstein. The…
