This is an appeal from a judgment in the Allen Circuit Court in which the appellant, Richard L. Zwick, was found guilty of the offense of the illegal sale of fireworks, as charged in the affidavit, and fined in the sum of one hundred dollars ($100.00) and costs.

This action was commenced by the filing of an affidavit in the city court of the City of Fort Wayne, Indiana, charging the appellant with “Illegal Sale of Fireworks.” Such affidavit, in pertinent part, reads as follows, to-wit:

“Undersigned, being duly sworn, upon oath, says: That on or about the 3 day of July, A.D., 1965, at the County…
