MEMORANDUM OPINION

GLEN M. WILLIAMS, District Judge.

Plaintiffs, Island Creek Coal Company (Island Creek) and Garden Creek Pocahontas Company (Garden Creek), instituted this action against defendant, Lake Shore, Inc. (Lake Shore), seeking damages for, inter alia, loss of income due to interruption of their mining business. The action arose over an accident at plaintiffs’ Virginia Pocahontas No. 6 (VP-6) mine that allegedly involved a steel sheave shaft that plaintiffs had purchased from defendant.
