One ground of the motion for a new trial *845assigns error on the following charge to the jury: “ The defendant contends that at the time the killing is alleged to have taken place, that he was justified because of the fact that the deceased was attempting to. commit a felony or other serious injury upon him amounting to a felony, and that he acted in self-defense, and that .the deceased.was attempting to have sexual intercourse with the defendant’s wife.
