This action was brought by the trustees under the last will and testament of Julius Sands, deceased, and a codicil thereto, to obtain a judicial construction and determination of the provisions thereof. The testator died on June 8, 1903, leaving a will dated June 23, 1892, and a codicil thereto dated February 8, 1899, both of which were duly admitted to probate. The testator left him surviving as his only heirs at law and next of kin his widow, Esther H. Sands, and three children, the defendant Rose or Rosa S. Rosenstein, who had, prior to testator’s death, married the plaintiff Benjamin H.…
