ORDER GRANTING DEFENDANTS’ MOTION TO DISMISS WITHOUT PREJUDICE
HOVLAND, Chief Judge.
Before the Court is the Defendants’ Motion for Summary Judgment filed on July 8, 2004. 1 For the reasons set forth below, the motion is granted.
I. BACKGROUND
On or about July 15, 2001, the plaintiff, Robert LaFromboise, Jr., a minor, entered the Quentin N. Burdick Memorial Comprehensive Health Care Facility located on the Turtle Mountain Indian Reservation in Belcourt, North Dakota.
