This is an action of trespass vi et armis, and involves a question of very great importance. It arises in the following manner: — one Joseph D. Worley of Baltimore city, purchased of Charles Rogers, the appellee, a stock of goods for $5314.80, and on the same day executed a mortgage bill of sale on said stock to secure payment of the purchase money in ten days.
