LIVINGSTON, Chief Justice.

This is an appeal from a decree of the Circuit Court of Marshall County, Alabama, *243in Equity, denying the relief prayed for and dismissing the bill filed by Lillie K. Head seeking the sale of certain-described property for a division among the joint owners, because the same could not be equitably divided in kind. The facts are virtually undisputed, and are as follows:
