MEMORANDUM OPINION AND ORDER

BUCKLO, District Judge.

Defendant Tri-State Management Company (“Tri-State”) entered into a general contract with the United States Postal Service to perform work on a post office building expansion. As required by the Miller Act, 40 U.S.C. § 270a et seq., TriState executed a payment bond. 1 Defendant North American Specialty Insurance Company (“NAS”) signed the bonds as surety.
