Donald A. Mutchler, David A. Basford 2 and Douglas Ray 3 failed to return to the Yakima-Kittitas County Work Release Facility after having lawfully checked out for the day. The State charged respondents with and the trial court convicted them of first degree escape, RCW 9A.76.110. Mr. Mutchler and Mr. Basford were found guilty after bench trials; Mr. Ray pleaded guilty. The court, after finding a violation of equal protection, 4 sentenced them under the more lenient sentencing grid applicable to RCW 72.65.070, willful failure to return to work release. 5 The State appeals, contending it was…
