Plaintiff brought this action to recover a sum of money 'alleged to be due him from defendant by virtue of'the latter’s assumption of an obligation originally owed to plaintiff by a third-party.

The circumstances may be summarized: The board of county commissioners of Barton county was engaged in extensive projects of road building, which necessitated the raising of large sums of money by the issue of bonds.
