The question presented for decision is whether this court should grant or should *596overrule the motion of the defendant, the Western Maryland Railway Company, to dismiss, for want of jurisdiction, the bill of complaint filed by the plaintiff, the Consolidation Coal Company, in whieh the plaintiff asks that a certain written agreement between it and the defendant be declared null and void; that the defendant be required to surrender the agreement for cancellation and be restrained from hereafter asserting that it is valid or enforceable, and, therefore, from…
