Mr. James Seldomridge was injured when performing warranty repairs on equipment installed in the expanded General Mills, Inc. (GMI) dough processing facility, which was built by Mr. Seldom-ridge’s employer. Mr. Seldomridge sued GMI for negligence. GMI filed a motion to dismiss for lack of subject matter jurisdiction, asserting that because Mr. Sel-domridge was a statutory employee his exclusive remedy was under workers’ compensation law.
