Hilton, Justice.

Plaintiff is the widow of Edward Stark, who died March 31, 1933, leaving plaintiff, then pregnant, and five minor children. The defendants are brothers of the deceased. At the time of Mr. Stark’s death, he and the plaintiff owned considerable personal property, consisting mainly of livestock, grain, and farm machinery, all of which was heavily mortgaged. Plaintiff was left without funds and in possession of a large farm which had been rented by her husband.
