MORTGAGES AND DEEDS OF TRUST – FORECLOSURE – PROCEEDINGS IN GENERAL – JURISDICTION – SUBJECT-MATTER JURISDICTION When a trustee seeks to foreclose a residential property via a power of sale, it is the Order to Docket that establishes the circuit court’s jurisdiction over that property. Without a complete Order to Docket, the circuit court’s jurisdiction over the property does not attach.
