After the close of the testimony upon the trial of this cause, the defendant below asked the court to instruct the jury, “that the uninterrupted possession of a slave for the space of five years gives the possessor the right, of property, unless there is some note, memorandum or instrument of writing acknowledged and recorded, showing the property to be in another, other than the possessor;” which instruction the court refused to give and the defendant excepted.
