This is a class action suit for recovery of money damages against a provider of title insurance to institutions making loans to *271homeowners.1 Named plaintiffs are homeowner-borrowers who refinanced mortgages on their homes. Their lender obtained lender’s title insurance from the defendant, Fidelity National Title Insurance Company [Fidelity].
