Henry Daniels appeals his conviction following jury trial for the class A felony of murder in the second degree. Mr. Daniels was sentenced as a persistent offender to twenty-five' years imprisonment for the death of Linda Smith. In this direct appeal, Mr. Daniels contends (1) that the trial court erred in denying his motion for judgment of acquittal at the close of all the evidence because the evidence was insufficient to prove beyond a reasonable doubt that a murder had occurred or that the defendant had committed it.
