The. defendant admits tbat tbe plaintiff is tbe owner of tbe legal title to the land described, but alleges that the plaintiff’s right of action accrued more than ten years prior to the commencement of this suit, and is barred by tbe statute of limitations. Tbe cause was tried to a jury and verdict and judgment were rendered for the defendant. The plaintiff appeals.

Day, J.-
i. practice: appeal: jurisdiction. I. At' tbe time of announcing tbe charge to the jury, the defendant excepted to the refusal to give certain instructions asked, and to the giving of all the . instructions given.
On the 13th day of September, the jury returned a general verdict for the defendant, and also certain special findings. Thereupon the plaintiff' gave notice of a motion in arrest of judgment, for a judgment in his favor, and for a new trial.
