Appeal by the defendants, the New York Christian .Missionary Society and another, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of Chautauqua on the 3d day of November, 1911, upon the decision of the court rendered after a trial at the Chautauqua Special Term.

In 1861 Laura Selleck conveyed the premises in controversy to the trustees of the Methodist Protestant Church of Fredonia, and the granting part of the conveyance contained the following: “ The above-described land being designed for church purposes. It is understood and agreed that the seats therein shall be forever free for the use of any and all persons to occupy in the capacity of worship. But if the seats of the church to be erected thereon or any other church thereon shall be rented or sold then the said above-described premises shall revert to said party of the first part or…
