O’NIELL, Chief Justice.

A bill of information was filed in the Ninth district court, in the parish of Rap-ides, charging that Vincent Chicóla and Tony Damico, Jr., on the 26th day of August,, 1937, willfully, maliciously and felo-niously, did break and enter the warehouse of the Stewart Service Station, in the night time, with intent to steal. On the same day on which the bill of information was filed. Chicóla and Damico were brought into court and were arraigned and pleaded guilty; and on motion of the district attorney, the defendants were sentenced, immediately, to be confined in the state…
