Appeal from a judgment of the Supreme Court (Czajka, J.), entered September 24, 1998 in Albany County, upon a verdict rendered in favor of plaintiffs.
Plaintiff Grigory Britvan (hereinafter plaintiff) suffered a comminuted fracture of the right heel when he fell from a scaffold on a construction site. As a result of pretrial motions, Supreme Court granted partial summary judgment to plaintiffs *800on the issue of liability.
