Plaintiff Floyd Heno appeals from a district court order dismissing claims for compensatory and injunctive' relief brought against the Federal Deposit Insurance Corporation (“FDIC”) under the Financial Institutions Reform, Recovery, and Enforcement Act (“FIRREA”). In an earlier opinion, see Heno v. FDIC, 996 F.2d 429 (1st Cir.1993), we affirmed the district court order dismissing the claim for injunctive relief pursuant to Federal Rule of Civil Procedure 12(b)(6), but vacated its Rule 12(b)(1) order dismissing the claim for compensatory relief.
