In November 1994, the Equal Employment Opportunity Commission (“EEOC”or “Commission”) issued a Commissioner’s Charge against Roadway Express, Inc. (“Roadway Express” or “Roadway”) alleging that it had engaged in and continues to engage in a pattern and practice of race and sex discrimination. The EEOC subsequently issued a subpoena requesting that Roadway Express supply certain hiring and promotions information.
