Plaintiffs, Harry Olsen and Draper & Kramer, Inc., appeal from a judgment entered in favor of defendants, James V. Celano, Jr., Marina Enterprises and Prairie Cove Marina, at the close of plaintiffs’ case during a bench trial. Defendant, Thomas J. Pitts, was not served with summons, did not participate in the proceedings before the trial court, and is not a party to this appeal.
