MEMORANDUM OPINION

This matter is before the Court on appeal by Hugo Etienne from an adverse final order of the respondent Commissioner of Labor (hereinafter referred to as the Commissioner) dated April 16, 1980. For the reasons set forth below, this cause will be remanded to the Commissioner.

In August 1975, petitioner Etienne injured his back during the course of his employment. Although his employer was covered by Workmen’s Compensation Insurance, petitioner did not notify the employer or the Commissioner of the injury but instead commenced a lawsuit against the employer alleging common law…
