HOLLAND, District Judge.

On September 14, 1944, complaint was filed by plaintiff, a citizen of Pennsylvania, seeking judgment on a promissory note executed by defendants, Lottie P. McLeod and W. J. McLeod, her husband, the note- being dated April 15, 1936. The defendant, Lottie P. McLeod, moves to dismiss. The motion was argued November 17, 1944, and time was granted for the submission of written briefs. The last brief was submitted January 4, 1945.
