OPINION

BUSSEY, Judge:

The appellant, George C. Cherbonnier, was convicted in the District Court of Hughes County Case No. CRF-84-70 of Child Abuse and was sentenced to 17 years imprisonment, and brings this appeal.

The facts disclosed by the record reveal that on July 31, 1984, the Police Department in Seminole received a phone call from a restaurant employee concerning a six-year-old boy on the premises who had apparently been beaten.
