delivered the opinion of the Court. To show a possession prior to the defendant’s, under the same title, the defendant was permitted to prove, that the premises had been possessed under a contract with one Jabez Cobb, which contract was presumed to have been given up, when another contract was made by J. B. Clarke with the defendant. The first contract with Cobb, was in September or October, 1800, and the second, for the same land, with the defendant, in July, 1802.
