Appeal from a judgment of the Supreme Court (McNamara, J.), entered December 5, 2006 in Albany County, granting plaintiff a divorce, upon a decision of the court.

The parties were married in 1976. Around 1996 or 1997, plaintiff was diagnosed with a general anxiety disorder. He was prescribed medications, including Xanax (a Benzodiazepine medication) and Ambien, to alleviate his constant worrying and inability to sleep.
