GRANT, Justice.
This is a case involving fraud in the sale of securities in which the appellant, Randal Floyd, was charged with having violated Tex. Rev.Civ.StatAnn. art. 581-29. 1
The indictment alleges that Floyd, on or about December 26, 1989, engaged in fraud in the sale of a security by failing to disclose to the buyer that liens for unpaid debts associated with and related to prior oil and gas exploration on the oil and gas lease which was the subject of the partnership interest offered for sale, and the site of a proposed new well, were then on file in the public records of St.…
