RAMSEY, Judge.

This appeal is prosecuted from a conviction had in the District Court of Erath County, on July 19, 1909, finding appellant guilty of murder in the second degree, and assessing his punishment at twenty-one years confinement in the penitentiary.

Appellant makes, for the most part, a very fair statement of the case in his brief filed herein, and we substantially adopt same. The homicide, it appears from the evidence, occurred on the outside of the house occupied by one Charlie Thompson, a young girl, for whose affections it appears that deceased and appellant were rival candidates.…
