This is an action brought to foreclose a mechanic’s lien filed against the defendant Teichman Engineering and' Construction Company as owners and contractors, and the defendants George H. Mundorf and Jennie E. Teichman, as sureties on a bond. Hnder an agreement dated December 4, 1909, the plaintiff agreed to furnish sand for the erection of a six-story apartment building by the defendant Teichman Engineering and Construction Company at One Hundred and Fifty-second street and McComb’s Dam road for the sum of $700, which agreement was accepted by the said defendant.
