Defendant was charged with the murder of his mother-in-law, Mrs. Rosario Maniscalco, and pleaded not guilty and not guilty by reason of insanity. A jury found that he was.guilty of murder of the first degree and did not specifically recommend the penalty; the same jury found that he was sane at the time he committed the murder. Defendant *482appeals from the ensuing judgment imposing the death penalty and from an order denying his motion for new trial.
