MEMORANDUM AND ORDER

HATFIELD, Senior District Judge.

The present action has its genesis in a logging accident on the Blackfeet Indian Reservation which ultimately resulted in the death of Leland Kicking Woman. Plaintiffs Marlys Bear Medicine and Delores Iron Shirt, as co-personal representatives of the Estate of Leland Kicking Woman, and Marlys Bear Medicine and Dana Murray, as guardians of Kicking Woman’s minor children, and Molly and George Kicking Woman, as Kicking Woman’s parents, bring this action under the Federal Tort Claims Act, 28 U.S.C. § 1346(b), §§ 2671 et seq.
